WHEREAS,
PAINTED HORSESHOE RANCH is the owner of the stallion DELTA
PROMISE, APHA #527,747 and the Mare Owner is the owner of the mare Registration
Number ,
Breed .
If presently in foal, due to foal .
AND
WHEREAS,
named stallion will stand at stud during the 2007 season at PAINTED HORSESHOE RANCH and the parties hereto desire to contract for
breeding during the season of 2007 at $ 950.00
(includes booking fee)
. Mare Owner will
contact PAINTED HORSESHOE RANCH
at (406) 466-5867 when mare comes in heat.
NOW
THEREFORE, IT
IS AGREED AS FOLLOWS:
1.
Upon payment of $250.00 booking fee (this is non-refundable),
the stallion owners do hereby reserve for the Mare Owner one season’s stallion service or frozen semen booking for 2007 to
named Stallion for the service of the mare.
2.
If this agreement is for
stallion service at PAINTED HORSESHOE RANCH:
A.
Mare owner agrees that board will be charged at the
rate of: $ 5.00 /day dry $ 6.00
/day wet.
It is expressly
understood that this is NOT an indoor boarding facility and the mare will be
kept outdoors.
B.
Mare owner agrees that all mares delivered to
stallion owner’s premises shall have:
1. Negative Coggins test
dated within 6 months of breeding and be current on vaccinations.
2. Mare to be wormed within
30 days of breeding.
C.
Mare owner agrees to have stallion owner’s
Veterinarian perform any services NECESSARY on mare, AT MARE OWNER’S EXPENSE. PAINTED
HORSESHOE RANCH will make every effort to contact mare owner prior to
any service performed EXCEPT in the
case of an emergency when a Veterinarian must be called immediately.
D.
Mares that are not halter broke will NOT
be accepted!
E.
In no event shall PAINTED HORSESHOE RANCH, Neal or Patty Bouma or their
representatives be liable for any sickness, disease, injury or death to the mare
or her colt. The mare owner
understands that PAINTED HORSESHOE
RANCH or their representative will use their sole judgment in caring for and
supervising the mare and her colt.
F.
Mare will not be released to the mare owner until such time as the
stallion service fee, all veterinarian expenses, board bills and other charges
incurred by mare owner or on behalf of the mare have been paid or reimbursed to
the stallion owner in full.
3.
If this agreement is for Frozen
Semen:
A.
The balance of the breeding fee and lab/shipping fee
must be paid to PAINTED HORSESHOE RANCH BEFORE the first shipment will be made.
Mare Owner agrees to pay a lab/shipping fee of $150.00 (FedEx
Overnight, UPS Overnight or counter-to-counter via airline) PER
SEMEN SHIPMENT, payable BEFORE each
shipment.
B.
Mare Owner agrees to pay a $250.00 deposit to PAINTED
HORSESHOE RANCH on a frozen transport container BEFORE
first shipment. This deposit will
be refunded when the mare is checked in foal or at the completion of shipments
and after the container has been returned undamaged.
Mare Owner agrees to return the
container IMMEDIATELY by
Overnight Express or Second Day Air at THEIR
expense. If Equitainer is not returned within 5 days, there will be an
additional charge of $10.00 per
day deducted from the deposit.

4.
A copy of the mare’s registration certificate MUST
be furnished.
5.
Live Foal Guarantee, with
rebreed privilege in season.
It is understood that should the foal not stand up and nurse, mare owner
will be entitled to a rebreed privilege in 2008.
Mare care or Lab/shipping charges will apply. If the mare does not produce a live foal in
2009, the Stallion Owner is released from any further obligation to rebreed and no fees will
be refunded. This guarantee
applies ONLY if Stallion Owner is notified within one (1) week from death of
foal. A statement must accompany
this notice from a licensed veterinarian. If
the rebreed privilege is not used in 2008, then any and all fees shall not be
refundable and this contract is thereby canceled.
6.
It is further understood that should the Stallion die or become unfit for
service, Mare Owner will have the option to breed to a different Stallion owned
by PAINTED HORSESHOE RANCH or be
refunded the breeding fee (minus the $250.00 non-refundable
booking fee and any shipping fees). If the mare dies or becomes unfit to breed, Mare
Owner will have the option to breed a different mare, subject
to Stallion owner’s approval, but no refund of breeding fee will be given.
7.
Breeder’s Certificates will be issued only when ALL related fees are
paid and stallion owner has been notified of the birth of the foal.
8.
This agreement shall be governed by the laws of the State of Montana.
It is specifically agreed that this is a Montana contract, subject to the
exclusive jurisdiction of the courts of Montana.
